The law of the Republic of Belarus of June, 19 2006 ¹128-3 introduces alterations and additions into the law of the Republic of Belarus “On Land Rent”.
In accordance with the abovementioned law ¹128-3 of June, 19 2006 article 16 of the law “On Land Rent” was reviewed. The article deals with the amount of land rent.
In particular, it is laid down that the sum of rental fee is fixed in a rental contract. Local executive and administrative bodies fix basic rent rates for state-owned land in accordance with its cadastral cost applying to the latter the coefficients defined by the president of the Republic of Belarus depending on the end use of the land.
While concluding rental contracts for the state-owned land local executive and administrative bodies are entitled to raising (lowering) basic rates of yearly land rent but no more or less than halve or double it. The factors influencing the decision of the authorities are: the term of rent, the size of a lot, the cost of ameliorations undertaken by the renter or fixed in the contract, the presence or absence of limitations (hindrances) in exploiting the land, social significance of renter’s activity for the administrative and territorial entities, seasonality, the time (daytime, nocturnal) and the type of activity as well as the source of its financing.
The given article regulating the amount of land rent was brought to conformity with the edict of the president of the Republic of Belarus ¹74 of February, 7 2006. The law of the Republic of Belarus ¹128-3 of June, 19 2006 “On the introducing of alterations and additions into the law of the Republic of Belarus “On land rent” comes into force on the day of its official publication.
