The “permit” stamps are to stay | Hanna Žarabcova

In its findings ¹ 3-189/2005 of October 4, 2005 the Constitutional Court of the Republic of Belarus has decreed to uphold the “permit” stamps for an unlimited term.

The case on the passport “permit” stamps was instituted on September 5, 2005 on demand of the Council of Ministers. The Court has primarily issued its findings, stating that the accountable state institutions had not assumed the measures necessary for the cancellation of the stamp from January 1, 2006. In consideration of the government’s proposals the Court prolonged the execution of its decision until the list of persons having legal restrictions to enter or leave the Republic of Belarus is set up.

Besides, the Constitutional Court provides recommendations to the institutions responsible for the implementation of the freedom of movement norm. The Court draws their attention to the necessity of adopting additional measures in order to simplify the procedure of the stamps procuring.
